These are the Void Breakout Terms and Conditions of Use (Terms) which form a legal and binding agreement between Darkstream Studio Limited (referred to as the Company, us, we or our) and Users. Any person (User/Player) accessing the Void Breakout website and/or mobile application (App), including any sub-domains, mobile sites, apps, APIs and widgets (hereinafter collectively referred to as the Platform), and any information, text, graphics, video, sound, pictures and other materials made available via the Platform (Content) for participating in games available on the Platform (Services) shall be bound by these Terms and all other rules and terms referred to herein or provided by Darkstream Studio Limited in relation to the Services.
By using, browsing or otherwise accessing the Platform and Services, you agree to be bound by these Terms and our Privacy Policy. We provide access to the Platform subject to these Terms. You agree that you have read and understood these Terms and the Privacy Policy, as amended from time to time.
We reserve the right to change any of the Terms at any time by publishing new Terms. We may notify you of changes by email to your registered email address or by in-app notification. If you do not accept the modified Terms within the time frame prescribed, you will be deemed to have accepted them. Participation in any game or viewing of certain content may be subject to further terms as notified from time to time. You agree to read and abide by the rules of each game as published and periodically changed by Darkstream Studio Limited.
We may, at our sole discretion: (a) move or remove any content on the Platform; (b) establish general practices and limits concerning use of the Platform; (c) assign our rights and liabilities in respect of User accounts to any entity (with intimation to Users).
Your use of information on our Platform (including results, statistics, data and news) is at your own risk. To the extent permitted by law, we make no warranty as to the accuracy or reliability of such information and disclaim all liability for any direct or indirect loss or damage arising from relying on anything contained in or omitted from our Platform.
Subject to these Terms, Darkstream Studio Limited grants you a personal, royalty-free, non-assignable, non-exclusive and revocable limited license to use the Platform solely for your own private use to play games of skill as provided by Darkstream Studio Limited. You are granted a limited, non-exclusive, non-transferable license to access and view Content solely in connection with your permitted use of the Services and for personal, non-commercial purposes.
The Services may change or be modified from time to time without prior notice. Darkstream Studio Limited reserves the right to change, modify or delete the Platform, services or Terms at any time. The Services may include advertisements; the types and extent of advertising are subject to change. Rules, scoring and guidelines for each game can be found within the game. Any charges for internet or data in accessing the Services are your sole responsibility.
To fully use the Platform you must register and create an account (Account). Each User may only open one account. Darkstream Studio Limited reserves the right to terminate duplicate accounts.
To apply for an Account you may be required to provide: full name, email address, password, phone number, date of birth, and such other details as specified on the App or website. You may register or log in through Google or email. You may be required to verify your mobile number via a one-time passcode. Permission to open an account is at our sole discretion. We may refuse any application without giving a reason. You must have a valid email address and mobile number. You must be at least 18 years of age (or the age of majority in your jurisdiction) to access the Platform. We may request proof of age at any time. Parents and guardians should monitor minors' online activities.
You agree to provide true, accurate, current and complete information at registration and to keep it updated. Upon grant of the Account you may use the Platform and play games. We may terminate your Account at any time for any reason. You must not permit others to use your Account or use another User's account. If we find that a User operates multiple accounts we may restrict or ban such accounts and any balance may be forfeited. Deposits and withdrawals are processed in cryptocurrency (e.g. USDT on TRON) as described in the App; you are solely responsible for supplying correct wallet addresses and for compliance with laws applicable to you. We are not a custodian of your external crypto wallets and do not control public blockchains. Your participation in any game is voluntary and at your sole discretion and risk.
The games hosted on the Void Breakout Platform are presented as games of skill where the impact of a player's effort and skill on the outcome is material. We do not support or endorse illegal gambling where prohibited. The outcome in our games depends on your effort, performance and skill; elements of chance may exist but skill and knowledge can substantially influence the result.
You agree that we may use technologies and monitor activities (including IP address) for security, fraud prevention and service improvement. You must comply with all laws applicable to you in your jurisdiction. We shall not be liable for your breach of applicable laws. Our reasonable decisions on eligibility and fair play are final.
Access to your Account is protected (including by OTP where applicable). You must have access to the phone number registered. You agree not to disclose your OTP or allow others to use your Account. We are not responsible if your Account is accessed by others due to your failure to protect credentials. You are solely responsible for all activities from your Account. You must protect your usernames, passwords, email and contact details. You are solely responsible for the accuracy of any cryptocurrency wallet address you provide for withdrawals; Darkstream Studio Limited is not liable for loss resulting from incorrect addresses, wrong networks, or user error on-chain. We will not incur liability for information you provide to others that results in exposure or misuse of your Account. Report unauthorised activity immediately to connect@voidbreakout.com.
In using the Platform you agree not to: (a) use automated means to access, scrape or index the Platform without our prior written consent; (b) interfere with the proper working of the Platform; (c) impose unreasonable burden or traffic on our infrastructure; (d) use Platform content to compete with us without authorisation; (e) transmit spam or mass messaging; (f) use the Platform in any unreasonable or unauthorised manner; (g) violate any person's rights including intellectual property or privacy; (h) pose as any person or solicit money or personal information; (i) breach any Term; (j) reproduce, modify, distribute or exploit the Platform or content except as authorised; or (k) transmit viruses or destructive items.
Content you submit must not be unlawful, threatening, abusive, defamatory, obscene, discriminatory, false, misleading, invasive of privacy, or otherwise objectionable. You must comply with all applicable laws and rules. We may not prevent all offensive content from being posted; you may report it and we will act as we deem acceptable. Our decision is final. We may prevent unauthorised access and report conduct to authorities. We may take legal action and/or restrict, suspend or terminate your access if you breach these Terms. You shall not sell, assign or transfer your Account or any content, currency, points or attributes. Remedial action may include: restricting, suspending or terminating access; deactivating or deleting your account (with settlement of any withdrawable balance per these Terms and crypto payout rules); or refraining from awarding prizes. You must provide true and complete information and keep it updated. You must ensure you can receive our communications. If you choose a username we consider obscene, abusive or likely to subject us to disparagement we may change or delete it. Unauthorised access is a breach of these Terms and may violate the law. You agree not to access the Platform by any means other than the interface we provide. Use of the Platform is subject to existing laws; nothing herein limits our right to comply with governmental or law-enforcement requests. We may not be held responsible for content contributed by Users.
In respect of transactions on the Void Breakout platform, you agree to the following. For participating in a game you pay a Contribution which includes: (1) a pre-designated platform fee (as notified) for access to the Services; and (2) a pre-determined contribution towards the prize pool, passed to winner(s) as per the game terms. Darkstream Studio Limited reserves the right to deny services to any User at its sole discretion. Unless otherwise stated, Darkstream Studio Limited acts to facilitate in-app balances and game payouts as described in the App.
Deposits and withdrawals are settled in cryptocurrency (e.g. USDT) via integrations and networks we specify in the App (including TRON as notified). You acknowledge that: (a) cryptocurrency transfers are irreversible once confirmed on-chain; (b) we are not responsible for the security of your external wallets, private keys, or third-party exchanges; (c) we are not liable for loss due to incorrect wallet addresses, wrong blockchain networks, memo/tag errors, network congestion, or actions of miners/validators; (d) market volatility, fees, and regulatory treatment of crypto are your risk.
In-app balances (e.g. Play Money and Winnings) are accounting entries used on the Platform as described in the App. Withdrawals are paid only to the crypto wallet address you submit; you warrant that the address is correct and on the required network. Darkstream Studio Limited is not liable if you lose funds due to your error or third-party wallet behaviour. We may require reasonable account checks for fraud prevention; this is not traditional bank KYC unless we expressly state otherwise. Where a game is cancelled or abandoned without an official result, entries may be void and Contribution refunded to your in-app balance as we determine. If a deposit does not credit within the time stated in the App, contact connect@voidbreakout.com from your registered email with transaction details. We may withdraw or cancel any game; refunds will follow App rules.
Void Breakout hosts games where winners may earn money by playing. Specific rules, scoring, time limits and prize structure for each game (including Ludo and others) are set out within the game and on the game page before you join. You agree to abide by the rules of each game as published. Time formats, extra chances, ranking and prize distribution may vary by game. Upon registering, the game begins as per the countdown or when sufficient players join; terms may include Play Money, Winnings, tickets, bonus etc. as disclosed at registration. Further terms may apply to each game and will be disclosed when you register or initiate the game.
Winners are decided on the basis of scores in the designated round. Users with the highest aggregate score are declared Winner(s). We may declare more than one winner and distribute prizes as specified on the game page. Winners are contacted at the registered email. We may require reasonable verification for fraud prevention or legal compliance; any specific requirements will be stated in the App. Payouts of winnings are made according to section H (crypto). You represent that any information you provide is accurate. We are not responsible for communication errors. The list of winners may be posted on the Platform. If you are declared a winner but do not receive communication, contact us within the time specified on the webpage.
You are responsible for reporting and paying any taxes applicable to your use of the Platform and any prizes or withdrawals, according to the laws of your jurisdiction. We may withhold or report amounts where required by applicable law. Our decision on awarding prizes is subject to these Terms. If a User in paid games is under the required age we may disqualify them and forfeit the prize and/or suspend or terminate the account. To the extent permitted by law we make no warranties as to prizes. Winners bear network fees and on-chain costs associated with crypto payouts. All prizes are non-transferable unless we state otherwise.
We are committed to fair play. Our compliance team will track gameplay and take strict action against Users who collude or use unfair means. You agree not to indulge in any unfair practice. We may take action including monetary penalties, temporary suspension, withdrawal blocking or permanent deactivation. Depositing and withdrawing without playing a reasonable amount of games may violate our fair play policy. Consecutive deposits and withdrawals may be treated as impermissible. Any User found to be fraudulent (e.g. depositing/withdrawing from a fraudulent account) may face legal action, confiscation of balance and account locking.
The Platform includes content created by Darkstream Studio Limited, partners, affiliates and/or Users. Intellectual property in all software, games, advertisements, content, graphics, marks and materials on the Platform is owned by Darkstream Studio Limited, its affiliates and licensors. You may not modify, publish, transmit, reproduce, create derivative works, distribute or exploit the Platform or content without our express written license. You may request permission by contacting our helpdesk. You are responsible for content you upload; you represent that you own the rights in it and that it does not infringe third-party rights. You agree to indemnify us against claims arising from your content. You grant us a worldwide, irrevocable, royalty-free, non-exclusive license to use, reproduce, distribute and display your content for operating and displaying it on the Platform and related purposes. All third-party names, logos and marks on the Platform remain the property of their owners.
Darkstream Studio Limited may capture visual/audio recordings, images and text from you for testimonials (Recordings). You grant us a royalty-free license to use, distribute and display the Recordings and your name, voice, likeness and biographical information for marketing, in any language and territory. We may incorporate the Recordings with other content for marketing. You waive any right to inspect or approve the finished use. Recordings are voluntary; we are the sole owner of all rights in the Recordings. We are not obligated to use them.
The Platform may contain links to third-party sites. Your use of those sites is subject to their conditions. We do not control third-party sites and are not responsible for their content. Our inclusion of links is not an endorsement. Your transactions with third parties (including payment and verification providers) are solely between you and that third party and subject to their terms. We are not responsible for any loss from such transactions. We do not guarantee the accuracy of third-party content.
You agree to comply with our Privacy Policy and any applicable guidelines, as amended from time to time, which are incorporated into these Terms.
Once a game has commenced, we are not required to refund your participation amount if you cannot play due to slow internet, faulty hardware, connection failure or similar reasons. In case of technical failures, server crashes or disruption at our end we may cancel the game(s) and refund participation amounts after verification; no service fee will be charged and we are not liable in such cases. We may cancel and refund in other cases at our discretion. We are not accountable for User disconnections except in case of server crash, and not liable for prospective winnings from incomplete games. We have no liability for disconnection, lag, freeze or network interference on your device or external networks.
By registering you accept all the Terms. We recommend you keep a copy of transactions and policies. Our failure or delay to act on a breach does not waive our rights. If any provision is held unlawful or unenforceable by a court of competent jurisdiction, the remaining provisions remain in effect; any invalid term may be replaced with a valid one of similar effect.
Darkstream Studio Limited disclaims all warranties, express or implied, in connection with the Platform and games, which are provided "as is". Your access and use are at your sole risk. We do not warrant quality, completeness, availability, security or fitness for a particular purpose of the software or Platform; continuous, error-free or virus-free operation; or that defects will be corrected. We shall have no liability for damages caused by matters beyond our reasonable control (third-party acts, network failures, viruses, etc.). To the maximum extent permitted by law you shall have no remedy in respect of any statement or representation not set out in these Terms. Any claim arising out of these Terms or the Platform must be asserted within one (1) year or be forever barred. We do not ensure that you can access your Account at all times (e.g. due to maintenance). You are aware that participation in games may result in financial loss; you participate voluntarily and assume all responsibility and risk. We make no guarantees regarding the games or financial outcomes. You assume the entire risk as to results and performance of any software or game; we disclaim liability for delay or failure from installation or use. We are not liable for: (i) defamatory or illegal conduct of others; (ii) loss from use or misuse of your Account; (iii) loss in transmitting information; (iv) technical failures or adverse technological occurrences; (v) accuracy or currency of information or statistics on the Platform. Nothing herein limits liability for death or personal injury caused by negligence or fraud.
To the maximum extent permitted by law, Darkstream Studio Limited shall not be liable (in contract, negligence or other tort) for any direct, indirect, incidental, consequential or exemplary damages including loss of data, income, profit, opportunity or goodwill, resulting from use or inability to use the Platform, even if we have been advised of the possibility of such damages.
You agree to indemnify us and our partners, directors, officers, employees and agents from and against any claims, liabilities, losses, costs and expenses (including legal fees) arising from: breach of these Terms; your use of the Platform; your breach of applicable laws; unauthorised use of your Account; your content; or use of the Platform by anyone using your credentials. This obligation survives termination of these Terms and your use of the Platform. You must ensure your activities on the Platform are legal under the laws of your jurisdiction. You agree to indemnify and hold us harmless from any claim or loss arising from your non-compliance with such laws.
We may change, suspend or discontinue any aspect of the Platform at any time, or impose limits on features, without notice or liability. We may do so where we believe there has been conduct that violates these Terms or is harmful to Users or our business. Upon termination you must discontinue use and destroy materials obtained from the Platform. You consent to the above and acknowledge we shall not be liable. Your representations, warranties and the clauses on indemnities, limitation of liability, license, governing law, jurisdiction and confidentiality survive termination.
Darkstream Studio Limited may enter into a separate agreement with the Agent for regulating obligations to give effect to these Terms, as we consider appropriate from time to time.
Acceptance of a prize constitutes permission for Darkstream Studio Limited and its affiliates to use the winner's name, likeness, voice and comments for advertising and promotional purposes in any media worldwide without further permission or compensation. Winners undertake to be available for promotional activities as planned by Darkstream Studio Limited. Promotional activities may include press events, ceremonies and similar.
You may escalate to our management by contacting connect@voidbreakout.com. These Terms are governed by the laws applicable to Darkstream Studio Limited's operations as we may specify, without regard to conflict-of-law rules that would apply another jurisdiction's laws. You agree to submit to the non-exclusive jurisdiction of courts in that jurisdiction for disputes not subject to informal resolution, except where applicable law requires otherwise.
In the event of a dispute, the party raising it shall provide written notification. The parties shall first try to resolve the dispute through good-faith discussions. If unable to resolve within thirty (30) days, either party may pursue remedies available under applicable law. Nothing herein prevents Darkstream Studio Limited from seeking injunctive or equitable relief where appropriate.
Void Breakout is committed to fair play. Our compliance team will track gameplay and take strict action against any User(s) caught colluding or indulging in unfair practices (e.g. coin dumping). By agreeing to these Terms you agree not to indulge in any unfair game practice that might give you or others undue advantage. We reserve the right to take action including monetary penalties, temporary suspension, withdrawal blocking or permanent deactivation. Any User involved in violation may be liable for prosecution. Any User found to be fraudulent (e.g. depositing or withdrawing from/to a fraudulent account) may be proceeded against including confiscation of balance and locking of the account. Users caught dumping value between accounts may be levied a minimum penalty; we may permanently block the account and forfeit balance (including pending withdrawals) if involved in malicious or unfair activity. By using the website or mobile application and/or registering, you authorise us or our representatives to contact you via email, phone or SMS (including third-party messaging apps) to offer our services, impart product knowledge and explain promotions. Irrespective of DND/DNC registration you authorise such contact for the above purposes while you are registered and as we consider appropriate thereafter.
